At CarbonBlack TyreXchange ("CarbonBlack") our most important asset is our relationship with you. We are honoured that you have entrusted us with your marketing and purchasing affairs, and we are committed to safeguarding the privacy of information we maintain about you.
Our privacy policy applies to all Users and Dealers with whom we have a relationship and extends to each of our former Users and Dealers.
Definitions used in this Privacy and Security Policy have the same meaning as those used in the Terms of Service. Please refer to the Terms of Service (Users) or Terms of Service (Dealers) for these definitions.
 
Key Elements To Our Privacy and Security Policy
(i)        You can access, update, or change Your Information at any time.
(ii)      You can opt out of the Service and delete Your Information at any time.
(iii)     You can use the Auction process but choose to opt out to receive email marketing or participate in market research surveys at any time.
(iv)     We use the latest technologies and best practices to secure all personal information.
(v)       We do not permit Third Parties to access your Personal Information unless you choose to make this information available.
 
1.                Information Collection
1.1      Use Of Your Information
In order to provide the Service to you it is necessary that we have your consent to undertake the following tasks:
 (a)    monitor and evaluate products and services;
 (b)    gather and synthesise information for statistical and research purposes;
 (c)    help provide you with better service or perform services on our behalf;
 (d)    respond to communications from you or as you authorize or request;
 (e)    take measures to detect and prevent frauds and credit loss;
 (f)     unless you opt out, to provide information on products and services offered by CarbonBlack, and external product and service providers. If you have provided us with your email or mobile phone details, we may provide information to you electronically with respect to those products and services.
 
1.2      Disclosure To Third Parties
Simply put, we do not and will not sell, trade, give or rent your Personal Information to anyone, for any reason, at any time unless:
 (a)    we believe that disclosure is required or permitted under law. For example, we may be required to disclose personal information to cooperate with regulatory or law enforcement authorities, to resolve consumer disputes, to perform credit/authentication checks, or for risk control, or;
 (b)    you expressly agree to us giving out your information, or;
 (c)    to help us process transactions for your account, or;
 (d)    you accept a Winning Bid on an auction item sponsored by Tyre Dealers. By accepting a winning Bid, you agree to CarbonBlack passing on your details to the Winning Dealer, and only this Winning Dealer, for the purpose of completing the Transaction with you. If you do not wish for your details to be shared in such a way, do not submit a request for Products and Related Services through CarbonBlack.
 Demographic data is only shared with CarbonBlack clients on an aggregate basis, without any Personal Information such as name and contact details.
 
1.3      What Information We Collect About You
 (a)    Application and registration information
  We collect information from you when you register on our website or participate in an auction or one of our marketing programs. You will also be asked for information when you choose to participate in a CarbonBlack promotion. The information we collect may include your name, address, phone number, email address, as well as details about your vehicle, tyres, driving habits and interests.
 (b)    Transaction and experience information.
  Once you have opened an account with us, we collect and maintain personal information about your auction activity, including your transaction history. This information allows us to administer your account and provide the services you have requested.
 (c)    Third-party information providers
  We may collect information about you from information services and consumer reporting agencies to verify your identity, employment or creditworthiness.
 (d)    Website usage
  When you visit our website, our computer may use devices known as "cookies," graphic interchange format files (GIFs), or other similar Web tools to assists us in understanding your preferences and enhancing your Web experience. These tools enable us to recognize you when you return to our site, and to maintain your Web session while you browse throughout the site, as well as help us provide you with a better, more personalized experience. Cookies do not, standing alone, identify you as an individual by name or account number; they merely recognize your browser. We do not sell this or any other information about you to other third parties.
 
2.                Security
CarbonBlack understands that you have entrusted us with personal, account and transactional information that is both important and confidential. We take our responsibility to protect your information seriously.
CarbonBlack updates its security and privacy standards to guard against identity theft and provide security for your account information. We constantly re-evaluate our security and privacy policies and adapt them as required to deal with new challenges.
CarbonBlack’s account protection efforts include but are not limited to the following:  
 
2.1              Authentication
We maintain strict rules for the creation of secure user IDs and passwords, designed to stop others from guessing your log in information.  
The Authentication process takes place when you log into your account. The two key components of login are your Login ID and Password.
 (a)    Your Login ID is your email address, and is unique to you.
 (b)    We maintain strict rules to help prevent others from guessing your password, and recommend that you change your password periodically. Your password must meet the following criteria:
  (i)   6 or more characters long;
  (ii)  case sensitive.
  In addition, for your protection, repeated unsuccessful attempts to log in will cause your online access to be disabled. Once this happens your password must be reset. If this happens to you inadvertently, please follow the instructions under "Forgot Password" on the Login page.
  
2.2              Web site Security
We use Secure Sockets Layer (SSL) technology and encrypted “cookies” to establish and maintain a secure transmission connection and encrypt data passing between your computer and our systems. This is designed to prevent anyone from intercepting or viewing your personal information.  
Another important information security measure in place throughout CarbonBlack’s Web sites is the timeout feature. This feature will log you out of your account if there has been no activity within a specified amount of time. It is designed to stop others from accessing your account if you fail to log out.
We have implemented these measures for your protection, but you should still remember to log out each time you have finished accessing your CarbonBlack accounts.
Our security measures include, but are not limited to:
 (a)    educating our staff as to their obligations with regard to your personal information;
 (b)    requiring our staff to use passwords when accessing our systems;
 (c)    encrypting data sent from your computer to our systems during Internet transactions and customer access codes transmitted across networks;
 (d)    employing firewalls, intrusion detection systems and virus scanning tools to protect against unauthorised persons and viruses from entering our systems;
 (e)    using dedicated secure networks or encryption when we transmit electronic data for purposes of outsourcing;
The Service uses Westpac Bank, a leading provider of e-commerce payment solutions to ensure a high level of security for processing all online financial transactions. All credit card, banking and account details are automatically encrypted before being transferred to the Westpac Bank to process the transaction.
 
2.3              Email Security – Policies to fight “phishing” and other email-related security challenges
 CarbonBlack is constantly re-assessing its email security and log in standards to provide protection against new and changing security challenges.
 
2.4              Transaction Monitoring, Employee Oversight and Access Control
 We use automated transactional monitoring tools to detect suspicious account activity. When these sophisticated systems flag a questionable transaction we contact the User or Dealer to be sure the transaction is legitimate and that it will be processed safely and rapidly. This combination of automated and manual transaction monitoring further strengthens the security we provide for your transactional and personal information.
 
2.5              Training – Employee training
 CarbonBlack employees are trained to safeguard your personal information.  
 
2.6              Steps you should take
 You play an important role in guarding your personal information and protecting your privacy. Here are some of the things you can do to protect your Account:
 (a)    Protecting the security of your computer
  (i)   Keep your computer and browser software current with security updates.
  (ii)  Install and update anti-virus and anti-spyware software and use personal firewalls to protect your computer.
  (iii)  Be alert to the threats posed by malware--short for malicious software, this form of software is designed specifically to damage or disrupt a system, or to secretly record information such as keystrokes. Malware types include key logging tools, trojan horses, hijacking programs, and dialer programs that may reside on your personal computer. While these threats constantly evolve, you can help protect your personal information and computer by using a personal firewall, maintaining up-to-date anti-spyware and anti-virus programs, and by immediately reporting any suspicious activity involving your personal information.
  (iv)          Do not enable any application features that would automatically log you in to your CarbonBlack account or pre-fill the Login ID or Password fields.
  (v)  Change your password periodically and avoid using passwords for CarbonBlack that you commonly use for other purposes.
 (b)    Using your computer
  (i)   Your username and password are for your use only. Do not share them with anyone.
  (ii)  Always log off after accessing your CarbonBlack account. This prevents someone else from accessing your account if you leave your computer unattended while the session has not yet “timed out,” or automatically shut down.
  (iii)  Be careful about using third-party computers or computers that you are not familiar with, such as those in Internet cafés.
  If you do use a third-party computer, be particularly careful to ensure you have fully logged out. CarbonBlack’s systems are set to prevent browsers from saving account information in a computer’s Internet cache, but as an extra precaution you may want to clear the cache of any public computer on which you have accessed your CarbonBlack accounts. Please check the browser’s help section to learn how to manually clear its Internet cache.
 (c)    Recognising and Fighting Fraud
  (i)   Do not provide personal or financial information in response to an email request or by clicking on a link, unless you are able to verify the authenticity of the site to which you are taken through the SSL padlock or other means.
  (ii)  Note that CarbonBlack will never ask you to provide personal  information in an email.
  (iii)  Do not open an email from a sender that your do not recognize. Be particularly cautious of any attachments to emails from unrecognized sources.
  (iv)          Immediately report any unusual activity regarding your CarbonBlack accounts through out Contact Us page.
 
2.7      Links To Other Web Sites
 Our web sites may contain links to non-CarbonBlack web sites. While such links are provided for your convenience, you should be aware that the information handling practices of the linked web sites might not be the same as ours.
 
3.                Disclaimer
 Despite these investments in technology and our comprehensive privacy and security protocols, it is the nature of the medium that the information stored on our servers and any data broadcast over the Internet can, in extreme circumstances be accessed by unauthorised third parties. We wish to assure you that we recognise this risk and have made significant investments in software and technology solutions, as well as adopting comprehensive security strategies, to ensure that this risk is minimised. However, while we strive to protect Your Information, we cannot ensure or warrant the security of it. Thus, any information you provide to us is accepted and stored subject to these risks. We will notify you immediately we become aware of any unauthorised access to Your Information should it occur.
